In New South Wales, there are two types of Apprehended Violence Orders (AVOs): Apprehended Personal Violence Orders (APVOs) and Apprehended Domestic Violence Orders (ADVOs). 

The classification depends on the relationship between the defendant and the Person in Need of Protection (PINOP). If charged with a domestic violence offence, such as common assault or intimidation, the police will likely apply for an AVO on behalf of the PINOP. Notably, an AVO is a civil order designed to protect the PINOP by imposing specific restrictions on the defendant’s behaviour; it is not a criminal charge. However, breaching the conditions of an AVO is a criminal offence, punishable by up to two years’ imprisonment and/or a fine of up to $5,500.

Each case is unique, and the applicability of defences varies based on individual circumstances.

FAQs

An ADVO is issued when the individuals involved have or have had a domestic relationship, such as partners or family members. In contrast, an APVO applies when there is no domestic relationship, for example, between neighbors or colleagues.

You can apply for an AVO by contacting your local police station, where officers can assist in filing the application on your behalf. Alternatively, you can apply directly through the Local Court. It’s advisable to seek legal advice to understand the process and implications fully.

Breaching an AVO is a criminal offence in NSW, punishable by up to two years’ imprisonment and/or a fine of up to $5,500. If the protected person believes the AVO has been breached, they should report it to the police immediately.
